An Open Plea to Gov. Gavin Newsom, Gov. Sisolak and Others

I need governors to unite and I don’t really know protocol so, I’m going to try the oldest method in the book: an open letter.

To the esteemed Governors of the truly caring states of these United States.

I have something that I don’t want you dismiss; I want you to think about it. Maybe you’ll see it as folly. Or maybe…

I have lived long enough to know that the only way for good to win is for bad to be too expensive to maintain. It’s a sad truth, but a truth nonetheless. Oh yes, also if there’s more money in doing the right thing, then it will be done and not until.

Take the opiate crisis if you will; many knew what was going on was simply legal drug pushing of a lethal drug, but it took going after the money, the Saclars, to actually start to do something about it. They were lying about a substance, and what that substance does, and then distributing it.

Because caring for opiate addicts, policing opiate addicts and all the other expenses of the opiate crisis costs states billions all told, and they wanted that money back. If the Saclars created the mess, knowingly, let the Saclars pay for it.

OK, so by the same logic, let’s look at the new opiate, just as addictive: lies about a medical pandemic and political divisions. Networks are making fortunes off of spreading actual lies about a pandemic and seeding sedition. Actual open sedition. And they do it behind the First Amendment these networks. But we all know that is NOT what the founders meant by freedom of the press: they meant the ability to speak truth to power and not be shut down. Not spread sedition and lies.

So the networks shield themselves behind something not meant to shield them and it’s allowed. But their distributors are not networks; they are not media, they are electronic distributors of media. They are not the press, they are newsstands. And the newsstand does not enjoy the same freedoms as the news makers.

But let’s talk brass tacs : How much has the misinformation about Covid cost the health care system, the states, the local governments, how much is misinformation costing the people in disruptions and cost of living? Truly how much? Millions? Billions all told? The Anti-Vaxers, the covid isn’t real people. The division, lies and hatred? There is a dollar amount there from business, health care, etc. They have cost a lot.

The Saclars were sued for the opiate crisis, even though people willingly took the drugs, because they lied about the drugs, their effects and hid behind regulations and were the pushers, the suppliers. It took brave people of each state to take them down, but they did.

Fox News, OAN and Newsmaxx, Twitter and Facebook must be stopped. They are ruining our lives literally with misinformation. And they are doing it by pushing the same opiate, misinformation for profit, to the masses. Those networks have cost the state of CA, NV, and others a lot of money because of the blatant lies and mistruths. The First Amendment was not about this: it was about repercussions from truth to power; not being shut down because you criticized a President, or King, it was never about lies, medical misinformation and sedition.

California, and other states, should band together against DirecTV, Spectrum, Charter, Cox Comm, and every cable provider that airs Fox News, OAN, Newsmaxx and enjoin Meta and Twitter in the lawsuit. If Fox won’t self-police, then they shouldn’t be distributed. OAN was just dropped by DirecTV. They know they are on the hook soon for money. The minute the case progresses they will pull those networks because the big corps won’t want to lose what they hold dearest: money. And the case could be made they are pushing the new opiate of the masses: Misinformation and governmental distrust. And it’s costing us lives and money. they lie, openly and without repercussion and call it freedom. Well, it’s costly. And it’s time someone other than we, the people, pay. The media companies know these networks are spreading lies, but they give them bandwidth. Cox, Spectrum, they program them happily. Well, then, they should pay. If the networks are untouchable under a warped view of the First, the distributors of the networks are NOT journalists, they are distributors of media, NOT media, and they can pay.
But it would take state’s governors to do it. Brave ones. It can and should be done. Or we lose our country. It’s that simple.

It is time to sue big media distributors for distributing costly misinformation to recoup what the taxpayers have had to spend because of it like states did for opiates. There’s precedent. Tie in the opiate cases with misinformation as the new addictive drug of the masses. Psychiatrist will tell you it is. This is real and this is a way to stop them.

If the “news” networks want a place to distribute their sedition, their medical lies, let it be online, on the fringe and not easily accessible. Make it too costly for media distributors, not just cable companies but Meta, Twitter and any platform, to put up information that is harmful to the population as a whole because it is based in lies or sedition. Telling people to eat horse dewormer, drink bleach, that Covid is fake, that a charlatan won and election when he didn’t, the founders would not want that to be labeled free speech. It harms the US, the body, the body politic.

I call upon you, Governors Newsom and Sisolak, to speak to your attorneys general and other governors, put a price tag on what Spectrum, Cox, Charter and the rest have cost through distributing the misinformation of Fox, OANN, Newmaxx and others. And make them pay.

It will not silence them, they will find other ways. But it will cut off their pipeline to the masses. The masses that are sick, dying, split and on their own against these giants.

Be our Daveys. Take on the media distribution companies that spread these lies. If Section 230 is not repealed, then find another way, and money is it.
